By accessing https://happybirthdaywishes.app you agree to these Terms. If you do not agree, do not use the site.
2. The service
We provide birthday wish lists, a wish generator that composes curated templates in your browser, card templates, and sharing tools for personal, non-commercial use unless we expressly allow otherwise. Features may change. Accounts and paid checkout are not offered in the current version; we may add them later under updated Terms.
3. Acceptable use
You agree not to:
- Use the site for unlawful, harassing, defamatory, or fraudulent content.
- Attempt to scrape, overload, reverse engineer, or disrupt the service.
- Use messages or cards to impersonate someone without permission.
- Submit malware or attempt unauthorized access.
We may suspend access for abuse.
4. User content and outputs
You keep rights to the text you submit. You grant us a limited license to process that text to operate the features you request. Wish lists and composed messages are provided as-is for inspiration; you are solely responsible for messages and cards you send to others.
5. Intellectual property
Site design, branding, curated lists (except your inputs), and software are owned by us or our licensors. You may not copy the site wholesale or resell our curated content as a competing dataset.
6. Third-party services
Hosting, CDN, analytics, and (when enabled) payment processors are provided by third parties under their own terms. We are not responsible for outages or acts of those providers beyond our reasonable control.
7. Disclaimers
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that outputs will be accurate, unique, or suitable for any occasion.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE IS LIMITED TO THE GREATER OF USD 50 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM (currently $0 while the service is free).
9. Indemnity
You will indemnify us against claims arising from your misuse of the site or from content you distribute to third parties.

Our Privacy Policy explains how we handle personal data and is part of your agreement with us.
11. Governing law
These Terms are governed by the laws of the State of California, USA, excluding conflict-of-law rules, unless mandatory consumer law in your country says otherwise. Courts in San Francisco County, California, will have exclusive jurisdiction for disputes that cannot be resolved informally, subject to mandatory local consumer protections.

We may update these Terms by posting a new version on this page. Continued use after the effective date means you accept the changes.
